Support law's change to favor elderly in Alabama

My mother will be 85 years old in November of 2004. Probate Judge Reese McKinney declared her a ward of the state and appointed LuAnn Long and Ed Parish as her guardian/conservator. The first thing these attorneys did was file a claim against me, the sole person my mother had nominated to be her guardian/conservator in the event of her incapacity.

At stake is control of over $50,000.00 in annual income and property assessed at over $100,000.00. I personally regard this as a form of elderly exploitation by the court and the lawyers involved in this atrocity.

My mother appointed me to be her attorney in fact for the duration of her natural life. She has been swindled by the court and ad litem appointed lawyers who have denied her expressed wishes and ignored her directives. This amounts to the destruction of my family by candy bar judges and get rich quick attorneys who are only interested in how much money and property they can take away from a helpless elderly person. Because of the greed based actions of these people my mother is essentially imprisoned at Crowne nursing home where she cannot leave and is forced to remain until the day she dies.

Ms. LuAnn Long is Vice-chair of the Montgomery Housing Authority, an agency which provides affordable housing to low income people. A portion of the housing they provide comes from estates raided by corrupt lawyers and a probate court system which appoints them. How can LuAnn Long possibly represent my mother's best interests when she ignores the orders of neurologists and specialist concerning my mother's health care and focuses her attention on liquidating her estate, an action which has forced her most loved son to relocate?

In my mind the Montgomery County probate court and its candy bar judge gets a big "F." They have flunked the course and failed miserably with respect to my mother's situation. Their blind justice is exactly that, blind as a bat and equally batty! Why should I give the courts of Alabama or ad litem attorneys appointed by them any further consideration with respect to the deplorable treatment they have given my mother, when they have demonstrated to me utter incompetence, corruption and failure? As far as I am concerned the elderly care system in Alabama is under funded, corrupt and broken. The good judgment of these candy bar judges has been melted away by their being elected instead of appointed and out in the sun of public criticism and score too long. As far as I am concerned these glutinous candy bar judges and their ad litem appointed attorneys can kiss my butt good-bye forever.

In defiance of the corrupt system I will continue to exercise my right of free speech to tell the truth, the whole truth and nothing but the truth and it is that the law in Alabama needs to be changed. Everyone should have a right to specify and designate whosoever they desire to be their guardian/conservator. To have given this power to probate court judges is to have taken it away from the people and made them like God.

Sorry, but I do not believe any probate court judge is God! These judges and lawyers are in it for the money and power. Their salaries should be significantly reduced such that only those truly interested in public service will continue in this line of work. Ad litem appointed attorneys who represent the elderly or mentally incompetent should be required to provide their services on a probono basis to avoid corruption.

Of course even if the law in Alabama is changed it will not come in time to help my mothers. The courts and their ad litem appointed attorneys have already hurt and harmed my mother and acted to destroy my family. Nothing can repair the damage these fools of folly have done.

However, if anyone whats to help me in my efforts to change the laws in Alabama they may do so by making a donation. Should making this request for money to help my mother be disapproved of by lawyers or the courts, that's no less than I'd expect. They do not want me to get any funds to help my mother or to use in a campaign to change the law in Alabama. These greedy, self-serving, power hungry candy bar judges and ad litem appointed attorneys want things to remain exactly as they are as it puts more money in their pockets, feeding their appetites, not for justice, but for wealth, power and the prestige which come with power and control. The last thing they want is an elderly mother's favorite son poking the thorn of truth in their sides to reveal the blood of corruption which oozes out of the wound.

It is not easy to get a law changed in Alabama. Most of the legislature spends the majority of their time sitting on their butts doing nothing constructive. These people beg for our votes and contributions, then when elected go to Montgomery and waste time and money, for what? Let's see if they really care about the citizens of Alabama by demanding that the law be changed to allow everyone to specify and designate who will be their guardian/conservator.

Also it is important that people may be able to specify and designate who will be their guardianship/conservatorship for the duration of their life that corrupt, greedy lawyers can not revoke the Durable Power of Attorney someone makes when they are competent as soon as they become incapacitated or incompetent. Unless this is done people simply can not plan for their futures and expect their wishes to ever be carried out because ad litem appointed lawyers may always come along and revoke their Durable Power of Attorney in favor of the lawyers, themselves.

With this said, I affirm that despite what the probate court of Alabama says, I regard myself as being the true and only guardian/conservator of my mother. The probate court of Alabama can go straight to Hell in a handbag! I say this knowing that my mother would say the same exact thing should she be herself and right in her mind. Sometimes you have to tell these corrupt candy bar judges and ad litem appointed lawyers where to go because they have the arrogant idea that they are God, given the powers they have been handed upon a plater while the people of Alabama were sleeping or more concerned about watching football games.

Thus as my mother's true guardian/conservator I will endeavor to speak those words she would speak herself. Some people in high places may not like this. But quite frankly I don't give a damn. My mother would quite kindly slam the door in their face and have nothing to do with them. I think in so doing she would be making a wise decision.
